Welcome to the Rhazes Global (“Rhazes Global”) website, we appreciate that you are using our services (“Services”). You, as the user (“User”), agree to follow General Terms and Conditions (the Terms) through using Rhazes Global’s Services. Please, read them carefully. Additional terms, are added to some of our Services, they will be part of the agreement with Rhazes Global, in case of choosing above mentioned services, together with the following. You will find additional Terms with corresponding Services.
Range of Services of Rhazes Global
1.1 Rhazes Global is a service platform designed to provide the market for healthcare providers including hospitals and clinics (“providers”); however, our service is not limited to them.
1.2 Each of Rhazes Global’s services provided additionaly to the User has an individual cost, covering case management, medical report translation, transfers, on-site translator, remote consultation (second opinion), visa assistance and organization of accomodation, etc.
1.3 Rhazes Global does not direct Users to specific Providers. Rhazes Global only provides information about Providers according to the User’s needs, for axample, geographic area, the time frame of availablility, health problems, etc. Thus, instead of being allocated to the provider, Users will be provided with the list of Providers in order to choose with whom to book an appointment.
1.4 Information and details: Rhazes Global discloses about Providers are based on data provided by the Providers or collected from variety of online and offline sources. Even though reasonable skill and care are used by Rhazes Global while performing services it doesn't guarantee that all provided information is accurate, correct or complete, also Rhazes Global cannot be held responsible for errors that may occur from the side of the Providers, including typographical or meaningful errors, untrue or misleading information or not delivering information at all. The Website is not and should not be construed as a recommendation or confirmation of the quality, level of service or qualifications of any Provider.
1.5 Rhazes Global ensures easy communication between Providers and the User. What Rhazes Global provides, are different forms the User can use by its own choice, to enquire information about Provider’s medical services. Rhazes Global does not participate in the contractual relationship between the User and the Provider, and in no way affects the conclusion or content of the contract. Rhazes Global does not assume any rights or obligations in relation to the User in accordance with the agreement concluded between the Provider or another third party and the User.
1.6 Rhazes Global is not a medical service provider itself, therefore the information provided on the webpage of Rhazes Global is not for replacing and cannot replace physician’s consultation or examination and should not be used to independently decide whether to start or stop treatment.
Conclusion of an agreement
2.1 Using the Services of Rhazes Global requires the User to provide personal contact information so that Rhazes Global or the Providers can assist the User with medical travel services. The user must provide his full name and phone number, email address and agree to these Terms and the Rhazes Global Privacy Policy (“Privacy Policy”).
2.2 The services of Rhazes Global are free for the User. But the User may also request additional personal or logistical support we provide or order other additional services for an additional fee. Before ordering a service for which a fee is charged, the User will see the exact amount of fee at the checkout page and will be able to finally edit the order data before clicking the “buy service” button.
2.3 Alongside the order placement, binding offer is submitted to Rhazes Global by the User, for the final conclusion of the contract for the requested service. Automatic confirmation email, according to the request, will be sent to the User, which is not a mandatory acceptance of the order.
2.4 Requesting personal and medical data removal from Rhazes Global’s database, users are able at any time by email request to [email protected]. According to the Privacy Policies, personal and specific personal data will be removed by Rhazes Global immediately, except the email address and the full name of the User in order to track and document the history of the requests of the User or the Providers in case of any legal disputes related to the Providers with which the User has contacted.
Additional Services
3.1 Free and paid Additional services, which the User can use to optimize their medical trip organization, are also provided by Rhazes Global. Price info of paid services will be provided by Rhazes Global as soon as these services will be selected by the User from the list on the website.
3.2 Additional Services present following and not only:
Rhazes Global Personal Assistance package includes:
- a dedicated care team member will manage the full case, assisting the User from inquiry, through treatment to recovery
- 24/7 availability to the inquiries
- possibility of provision of a variety of personalized treatment plans, therefore comparing prices
- appointment scheduling
- secure payment since Rhazes Global acts as a guarantor of any deposits paid as a payment for the user's medical care.
Transfer service from airport to hotel, from hotel to hospital. This service includes a car service and driver to serve you during your treatment process. We also provide air and ground ambulance with discount, User will be able to see package rates upon request.
Visa assistance. Via this service, we provide invitation letters, which may be required for getting a medical visa. This does not apply to any additional costs that must be paid directly to the Embassy.
Medical Interpreter who accompanies you through the treatment process. This hourly paid service ensures and supports the right communication between the User and the medical staff of the hospital and is available for booking for a minimum of 2 hours. The User gets a discounted rate when booking time exceeds 8 hours.
Logistic assistance. Support in nuances like searching and booking tickets and accommodation. All available options will be presented to the User by our Care Team member. Travel and accommodation are not provided by Rhazes Global. The user is covering all the costs related to flights and accommodation.
Second Opinion, remote consultation. Rhazes Global can arrange the examination of the User’s medical files by a specialist doctor in order to obtain a second opinion about the User’s current medical diagnosis. The result of the second opinion service is a report compiled by the selected specialist. The Rhazes Global Remote Second Opinion service includes assistance in identifying a specialist, sharing medical files, and transmitting a final report to the User.
Second Opinion
4.1 Second opinion services are provided by Rhazes Global upon the request the User submits. Through a second opinion the User gets evaluation of his/her current situation, past condition, diagnosis and treatment plan by the phyisician he/she chooses. This is not a primary carensubstitute. Prior to using Rhazes Global Second Opinion, users should seek primary care from a local medical professional.
4.2 The User should agree and accept that: the diagnosis obtained is limited and conditional; the second opinion cannot replace a full medical examination/evaluation or a personal visit to a doctor; health workers providing second opinion services do not have important information that can be received with physical examination; and the lack of a physical examination may affect the ability of the healthcare provider while diagnosing the condition, diesase or injury of the User.
4.3 The user may, at his discretion, consult a second opinion doctor if available, if the medical case cannot be evaluated remotely, even after receiving all the necessary medical records.
4.4 Rhazes Global Second Opinion provides The User with a wide range of additional information though physicians from its Providers network. The second opinion applies to all major medical specialties on the Rhazes Global website, including general surgery, cardiology, oncology, neurology, orthopedics, dentistry, ophthalmology, gynecology etc. If there is no right specialist in Rhazes Globals Providers network, Rhazes Global contacts to the third parties, outside its network of Providers, upon the User's Approval.
4.5 After accessing any service through the website, the User permits Rhazes Global to compile, store and transfer the medical records of the User to the appropriate physician or physicians for the case. The Second Opinion will not be used in any legal dispute, including lawsuits, arbitration, claims for disability benefits, claims for compensation of employees and/or claims for malpractice, etc. By prior notifying Rhazes Global that a third party is a family member of the user, the user may provide the medical records through the third party, and the user has prior agreement with the third party to represent him/her, and the third party cannot send the request through the portal on his own.
4.6 The informatin Providers and other third parties provide to Rhazes Global, is not a substitute for physician’s consultation or medical examination. Information should not be used to independently decide whether to start, continue or stop treatment.
4.7 The User must provide Rhazes Global with up-to-date and accurate identification information, contact and other information to verify the identity. Maintaining accuracy and completeness of this information, also certifying that information is accurate is the User’s responsibility.
4.8 The User agrees that Rhazes Global may at any time review the User’s medical reports before and after his/her cooperation with the portal, as well as any records created as a result of the services received. Rhazes Global may request additional medical records, including those related to care that the User received after receiving second opinion services. Rhazes Global may review these records to better understand the course of treatment for the user's condition (s), including information on results and costs, as well as to improve treatment and recommendations.
4.9 Rhazes Global will create a Medical Case File after receiving complete and accurate documentation from the User. Medical Case File will be sent up to 3 Doctors from Rhazes Global’s Providers’ network, by User’s choice and in accordance with the field of the User’s disease. The user will receive a confirmation email that the case is ready for sending to the doctor. After riceiveing the second opinion report form the doctor, it will be forwarded to the User by Rhazes Global.
Payments and Cancellation
5.1 The last step the user will make in the Second Opinion Service will be an online payment. Cancellation of the purchase is possible up to 14 days, before the request will be rendered by Rhazes Global Team or the Provider. Cancellation will cause the charge of 50% of payment, the refund of the rest 50% will occur within 15 working days.
Rating Systems
6.1 In order, for the Users, to exchange opinions and experiences and be able to evaluate Providers with the rating system and by this act like recommendators to Rhazes Global, providers or other Users, certain type forums and rating systems are set-up on our website. By these rating systems Users’ personal perceptions, experiences and and examinations are expressed. Rating systems may be shut down or stopped by Rhazes Global but the User has no right to interrupt its impeccable functioning.
6.2 For the Users it’s only possible to rate Providers or other third parties services they used personally. Making ratings that are based on untrue facts, are slanderous or are forbidden by law (because of their abusive or defamatory nature) in user forum Rhazes Global provides is prohibited.
6.3 The User accepts storing and publication of his/her ratings made through the forums long term, regardless of the ending of the User’s registration in Rhazes Global.
User's Obligations
7.1 Rhazes Global’s services are available for individuals over 18 years old. The user has the right to use the Rhazes Global Services on through the third party under the age of 18 years and informs Rhazes Global of any activity carried out on behalf of the third party.
7.2 The user must provide only true and up to date information to Rhazes Global, Providers or third parties on this website or in connection to all the Services Rhazes Global provides.
7.3 In case of violation of the user's obligations, Rhazes Global has the right to delete the relevant information, and taking into account the legitimate interests of the corresponding user - temporarily or permanently block the User's account.
7.4 If the third party makes a claim in respect of Rhazes Global due to a guilty violation of the User’s obligation, the User is obliged to reimburse Rhazes Global for the claims of the third parties, as well as expenses that may be incurred by Rhazes Global as a result of appropriate legal protection (for example, legal fees and attorney fees). Rhazes Global also has the right to claim further damage compensation.
Liability of Rhazes Global for own services
8.1 Except as expressly provided in these Terms or additional terms, Rhazes Global makes no promises or representations about the quality of the Services it provides and does not provide any warranties regarding these Services.
8.2 Rhazes Global is only liable for intentional acts or gross negligence.
8.3 For claims related to harm to life, body or health, Rhazes Global is also responsible for mere negligence.
8.4 Rhazes Global is also responsible for simple negligence contractual obligation is violated. Such a material obligation, which jeopardizes the fulfillment of the purpose of the contract, arises if orderly execution of the contract is possible, only if the corresponding obligation is fulfilled and if the User can believe that these obligations will be fulfilled. The User’s claim for damages in case of violation of material obligations on the basis of simple negligence, however, is limited to losses that are predictable and typical for this type of contract.
No Liability for Services of Third Persons
9.1 The Rhazes Global website contains cross-links to websites owned by the third parties (such as Providers, travel agencies or certification bodies), Rhazes Global has no influence on their contents. Only the respective owner or operator of the websites is responsible for their contents. Rhazes Global assumes no responsibility for this external content. Related sites were thoroughly checked by Rhazes Global for possible violations of the law when they were first linked to; at that time there was none that could be noticed. However, Rhazes Global does not check continuously the links for changes that could form a new basis for responsibility. However, Rhazes Global will remove the link to the third-party website if it becomes probable that the content of the linked website is illegal and may cause any responsibility of Rhazes Global.
Data Protection
10.1 The website of Rhazes Global and the content of it may only be used for non-commercial, personal purposes by the User.
10.2 The full content of this website is protected under copyright and intellectual property rights and somewhat originated from third parties. Intellectual property rights in the website, including texts, graphics, logos, images, photos, videos, logos, etc. are the property of the Providers, Third parties or Rhazes Global itself. The User is not granted any intellectual property licenses of Rhazes Global in relation to the Services provided and information provided by Rhazes Global while using the services. Any use is not permitted by copyright law requires the prior written permission of Rhazes Global. Downloading and copying materials from the Rhazes Global website is permitted only for private and non-commercial use.
10.3 Rhazes Global has the right to use the information provided by the user if its requests and messages (for example, between Providers and with them) or activities in forums, etc. For Rhazes Global business, only such use must comply with data protection regulations.
Validity and Change of the Terms; applicable law; venue
11.1 Only Rhazes Global’s Terms apply concerning the use of Rhazes Global website with its services by the User. Hereby, general terms and conditions are rejected.
11.2 These Terms remain valid unless they are amended or terminated by Rhazes Global. If the User does not agree with these Terms, he/she must immediately stop using the Services, and close his account.
11.3 These Terms, as well as any additional Terms applied to specific services Rhazes Global provides, can be modified by Rhazes Global alongside with applying notification about changing Terms on this website with changed Terms which will not become active at least fourteen (14) days from posting. Yet, specific types of changes, such as the ones made for legal reasons or new functions of services will be applied immensely. The User has to terminate the utilization of Service in case of not accepting modified Terms.
11.4 If there is any discrepancy between the Terms and additional terms applicable to specific Services provided by Rhazes Global, the additional Terms will prevail in the event of non-compliance.
11.5 To the range which is permitted by law, these Terms with additional conditions applied to specific Services provided by Rhazes Global, as well as any disagreements arising or related to the relevant conditions, are regulated exclusively by the laws of Azerbaijan (without choosing the provisions of the law).
11.6 Any conflict that arises out of these Terms and Services shall be referred exclusively to the competent courts in Azerbaijan. If this kind of choice of the place is not allowed by mandatory statutory law, all allegations that arise from or are related to these Terms, as well as any additional conditions for specific Services provided by Rhazes Global, with the Services, should be litigated in the courts compatible with the statutory law.
11.7 In case any provision of these Terms is or will become invalid, void or optional, the User will still be bound by the rest of provisions of these Terms. An invalid provision should still be applied to the range permitted by law.
